1. Introduction and Acceptance of Terms

Welcome to Dewy Outfit! These Terms of Service ("Terms") constitute a legally binding agreement between you and Dewy Outfit ("Dewy," "we," "us," or "our"), a company registered under applicable laws. These Terms govern your access to and use of:

  • The Dewy mobile application ("App")
  • Any related services, features, content, or functionality ("Services")
  • All associated websites and networks operated by Dewy

License to Use

Subject to these Terms, Dewy grants you a limited, non-exclusive, non-transferable, non-sublicensable license to:

  • Download and install a copy of the App on a single mobile device
  • Access and use the Services for your personal, non-commercial use
  • Access and view any content made available through the Services

This license is conditioned upon your compliance with these Terms. All rights not expressly granted to you are reserved by Dewy.

Privacy Policy

Your privacy is important to us. Our Privacy Policy, available at www.dewyoutfit.com/privacy, explains how we collect, use, and protect your personal information. By using our Services, you agree to our Privacy Policy and consent to our data practices described therein.

Display and Consent

These Terms are always accessible in:

  • The App's settings menu
  • The footer of our website

You must explicitly agree to these Terms when:

  • Creating a new account
  • After significant updates to these Terms
  • When prompted by the App for re-confirmation

Definitions: Throughout these Terms, certain terms will have specific meanings:

  • "User," "you," and "your" refers to any individual who accesses or uses our Services
  • "Content" includes all text, images, photos, audio, video, outfits, location data, or other materials you may encounter on our Services
  • "User Content" means any content that users submit, post, or transmit through our Services
  • "Intellectual Property Rights" means all patent rights, copyright rights, moral rights, rights of publicity, trademark rights, trade dress and service mark rights, goodwill, trade secret rights, and other intellectual property rights

Acceptance of Terms: By downloading, installing, accessing, or using our Services, you expressly acknowledge that:

  • You have read, understood, and agree to be bound by these Terms
  • If you do not understand or agree to any part of these Terms, you must immediately cease using our Services
  • You have the legal capacity to enter into these Terms (you must be at least 18 years old)
  • These Terms may be updated from time to time, and your continued use constitutes acceptance of any changes

Electronic Agreement: By using our Services, you consent to entering into these Terms electronically, and acknowledge that your use constitutes your electronic signature, which has the same legal effect as a physical signature.

1. Eligibility

Before creating an account on Dewy, you must be eligible to use our Services. By using our Services, you represent and warrant that:

  • You are at least 18 years old;
  • You are not located in a country that is subject to a U.S. Government embargo (including Cuba, Iran, North Korea, Syria, and the Crimea region) or that has been designated by the U.S. Government as a "terrorist supporting" country;
  • You are not on any U.S. Government list of prohibited or restricted parties;
  • You are not prohibited by law from using our Services;
  • You have not previously been removed from our Services;
  • You will maintain only one active account at any time;
  • You have a compatible iOS device running the latest required version of iOS;
  • You have sufficient data access and are responsible for any associated carrier charges;
  • You agree to comply with all applicable local laws in your jurisdiction;
  • You understand we may require identity verification at any time.

If at any time you cease to meet these requirements, your authorization to access our Services is automatically revoked, and you must immediately delete your account. We reserve the right to verify your eligibility at any time and may suspend or terminate your account if we have reason to believe you do not meet these requirements.

Your Responsibilities

As a user of our Services, you agree to:

  • Comply with these Terms and check for updates regularly;
  • Use the latest version of the App;
  • Treat other users with respect and courtesy;
  • Present yourself authentically and share only your own outfits;
  • Maintain the security of your account and login information;
  • Report any inappropriate content or behavior;
  • Respect other users' privacy and personal information;
  • Comply with all applicable laws and regulations.

Prohibited Content

When sharing outfits and using our Services, you must not post or share content that:

  • Contains nudity, explicit content, or inappropriate clothing;
  • Features any person other than yourself without their explicit consent;
  • Features any person under 18 years of age;
  • Promotes hate speech, discrimination, or harassment;
  • Contains commercial advertisements or promotional material;
  • Includes spam, malware, or malicious content;
  • Violates any third party's intellectual property rights;
  • Contains false or misleading information;
  • Promotes dangerous or harmful activities;
  • Contains affiliate links or unauthorized commercial content;
  • Damages the reputation of Dewy Outfit or its users;
  • Was not created by you or is automatically generated;
  • Contains location information that could compromise personal safety.

Posting any prohibited content may result in immediate account suspension or termination. We reserve the right to remove any content that violates these terms or that we determine to be inappropriate for our Services.

2. Your Account

When you create an account with us, you must provide accurate, complete, and current information. You can create an account using:

  • Your phone number (using SMS verification)
  • Your email address (using email verification)
  • Your Google account
  • Your Apple ID

You are solely responsible for maintaining the security of your account and your device. This includes:

  • Keeping your phone number and email address up to date
  • Ensuring no unauthorized access to your verification codes
  • Maintaining the security of your Google or Apple account if you use those to sign in
  • Protecting access to your mobile device

You agree to accept responsibility for all activities that occur under your account. If you discover any unauthorized use of your account, you must notify us immediately at contact@dewyoutfit.com. If you use social login (Google or Apple), you agree that we may access and use the information these services provide in accordance with their terms and our Privacy Policy.

3. User Content

Our App allows you to upload, post, and share outfit photos and related content ("User Content"). You retain all rights to your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute it in any media.

You represent and warrant that:

  • You own or have the right to share all User Content you post
  • Your User Content doesn't violate any third party's rights
  • Your User Content complies with all applicable laws and regulations
  • Your User Content is appropriate and relevant to the App's purpose

4. Prohibited Activities and Acceptable Use

To maintain a safe and respectful environment for all users, the following activities and behaviors are strictly prohibited. Engaging in any of these activities may result in immediate account suspension or termination, and where applicable, legal action may be taken.

4.1 Illegal Activities

  • Using our Services for any unlawful purpose or in violation of any laws
  • Promoting or facilitating illegal activities
  • Violating any applicable local, state, national, or international laws
  • Engaging in fraudulent or deceptive practices

4.2 Security Violations

  • Attempting to gain unauthorized access to our systems or other users' accounts
  • Interfering with or disrupting our Services or servers
  • Uploading malware, viruses, or other malicious code
  • Attempting to probe, scan, or test the vulnerability of our systems
  • Bypassing or attempting to bypass any security measures
  • Using automated systems or software to extract data from our Services ("scraping")

4.3 Content Restrictions

  • Posting violent, graphic, or otherwise disturbing content
  • Sharing sexually explicit or pornographic material
  • Promoting hate speech, discrimination, or harassment
  • Spreading false, misleading, or deceptive information
  • Impersonating others or providing false information about your identity
  • Sharing content that promotes self-harm or suicide

4.4 Intellectual Property Violations

  • Infringing on intellectual property rights of others
  • Using copyrighted material without proper authorization
  • Removing or altering any copyright, trademark, or other proprietary notices
  • Using our trademarks or branding without explicit permission

4.5 Abusive Behavior

  • Harassing, stalking, or intimidating other users
  • Engaging in targeted abuse or harassment
  • Making threats of violence or harm
  • Bullying or encouraging others to bully
  • Sharing personal or private information of others without consent ("doxxing")

4.6 Spam and Commercial Abuse

  • Sending unsolicited promotional or commercial messages
  • Creating multiple accounts for deceptive purposes
  • Artificially manipulating likes, follows, or engagement
  • Using our Services primarily for commercial purposes without authorization
  • Conducting unauthorized contests or promotions

4.7 Enforcement

We reserve the right to:

  • Remove any content that violates these terms
  • Suspend or terminate accounts for violations
  • Report illegal activities to law enforcement
  • Take any other appropriate action to protect our Services and users

The above list is not exhaustive, and we reserve the right to determine what constitutes a violation of these Terms. Users are encouraged to report any violations they encounter through our in-app reporting system.

5. Mobile App Specific Terms

5.1 App Permissions

To provide our services, our App requires access to certain device features:

  • Camera - Required for taking outfit photos
  • Location Services - Required when sharing outfit locations

5.2 App Updates

We may automatically update the App when new versions are available. These updates may be required for continued use of the App. You agree that we may automatically deliver such updates to you as part of your use of the App.

5.3 Mobile Data Usage

Using the App may consume data through your mobile data plan. You are responsible for any fees or charges incurred from your mobile service provider for data usage.

5.4 Auto-Renewable Subscriptions

Our App offers auto-renewable subscriptions for premium features, available in monthly and annual terms. By subscribing, you agree to the following terms:

  • Your subscription will automatically renew at the end of each period unless cancelled at least 24 hours before the renewal date
  • Payment will be charged to your App Store account at confirmation of purchase and for renewals
  • The cost of renewal will be the same as your original subscription price unless you are notified of a price change in advance
  • All subscription management, including cancellations and refunds, must be handled through your device's App Store settings, as Dewy cannot process these directly

Refunds: All refund requests must be made through the App Store. Dewy Outfit cannot issue refunds directly for subscriptions. To request a refund, please contact App Store Support.

5.5 Account Deletion

You can delete your account at any time through:

  • The App's settings menu under "Account" → "Delete Account"

Upon account deletion:

  • All your personal data will be permanently deleted within 30 days
  • Your content will be removed from public view immediately
  • Active subscriptions must be cancelled separately through the App Store
  • Deletion is permanent and cannot be undone

6. Intellectual Property and Copyright

The App and its original content (excluding User Content), features, and functionality are owned by Dewy Outfit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Content Guidelines

All content uploaded to Dewy Outfit must be safe for work (SFW) and not infringe on the intellectual property rights of others. Users may not upload copyrighted material without permission. By uploading any content, including outfit photos, you represent and warrant that you own the rights to the content or have explicit permission to share it.

Copyright Infringement & Reporting Process

If you believe that any content on Dewy Outfit infringes on your copyright, please follow our two-step reporting process:

Step 1: In-App Report

First, use the report button within the app to flag the potentially infringing outfit. This helps us quickly identify and review the content in question. When reporting, select "Copyright Infringement" as the reason for your report.

Step 2: DMCA Takedown Request

After submitting an in-app report, send a formal DMCA takedown request to contact@dewyoutfit.com with the subject "DMCA Takedown Request." Your email must include:

  • A description of the copyrighted work
  • The approximate date when you reported the content in the app
  • A statement that you own the copyright or are authorized to act on behalf of the owner
  • Your contact information (name, email, phone number)
  • A statement, under penalty of perjury, that the information in your request is accurate

Dewy complies with the Digital Millennium Copyright Act (DMCA) and will investigate and take appropriate action on reported content. We reserve the right to terminate the accounts of users who repeatedly infringe on copyrights. Please note that filing false copyright claims may result in account termination.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free.

9. Limitation of Liability

Dewy is provided "as is" and without warranties of any kind. We do not guarantee the accuracy, completeness, or availability of the App or its features. Under no circumstances shall Dewy Outfit be liable for any damages arising from your use or inability to use the App.

9.1 Specific Limitations

You specifically acknowledge and agree that we shall not be liable for:

  • Loss of data or outfits you've posted
  • Technical issues or service interruptions
  • Actions of other users or third parties
  • Unauthorized access to your account
  • Any data breach or unauthorized disclosure of information, despite our reasonable security measures
  • Issues arising from third-party services, including but not limited to the App Store, payment processors, and authentication providers
  • Loss of profits, revenue, or data
  • Any consequential, incidental, or punitive damages

9.2 Data Security and Backups

While we implement reasonable security measures, you acknowledge that:

  • No data transmission over the internet is 100% secure
  • You are responsible for maintaining copies of your content
  • We do not guarantee the recovery of lost data
  • We are not liable for any loss resulting from unauthorized access to your account

9.3 Third-Party Services

Our App integrates with third-party services. You acknowledge that:

  • We are not responsible for third-party services or content
  • Your use of third-party services is at your own risk
  • We do not endorse or warrant any third-party service
  • Third-party services may have their own terms and privacy policies

9.4 International Use

If you access our App from outside the United States:

  • You do so at your own risk and initiative
  • You are responsible for compliance with local laws
  • We make no representations about compliance with local laws
  • We may limit or restrict access from certain regions
  • Your data may be transferred to and processed in the United States

Maximum Liability: If, despite the above limitations, we are found liable for any loss or damage, our total liability shall not exceed the greater of: (a) the amount you paid for our services in the 12 months prior to the claim, or (b) $100 USD.

10. Changes to Terms

We reserve the right to update these Terms at any time. It is your responsibility to regularly review these Terms. Your continued use of the App after any changes constitutes acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

11.1 Informal Resolution

We believe in resolving issues through open communication. If you have any concerns or disputes:

  • First, please contact us at contact@dewyoutfit.com to discuss your concerns
  • We commit to reviewing and responding to all concerns within 5 business days
  • We'll work with you in good faith to find a fair resolution
  • Most issues can be resolved through this direct communication

11.2 Formal Dispute Resolution

If we cannot resolve a dispute informally within 30 days, either party may seek to resolve the dispute through appropriate legal channels. Any formal legal proceedings must be filed and maintained in courts of competent jurisdiction.

11.3 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. For any matters not subject to informal resolution, you agree to submit to the personal jurisdiction of the courts located within California for the purpose of litigating all such claims or disputes.

11.4 Limitations on Claims

Any claim or cause of action arising out of these Terms or the use of our Services must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred, notwithstanding any statute of limitations or other law to the contrary.

11.5 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
